New Judge Appointed — posted December 15, 2009 San Diego attorney Margaret Mann has been appointed to serve as a judge of the United States Bankruptcy Court for the Southern District of California. The appointment, announced by Chief Judge Alex Kozinski of the U.S. Court of Appeals for the Ninth Circuit, is contingent upon approval of background clearances. She will succeed Bankruptcy Judge James W. Meyers, who is scheduled to retire early in 2010. Read more about the appointment. Mandatory Electronic Filing - General Order 162-A — posted December 1, 2009 After 11 years of “voluntary” electronic filing by attorneys and trustees, the Southern District of California has determined it is time to mandate the electronic filing and submission of all documents filed by attorneys and trustees in this court, effective March 1, 2010. General Order 162-A amends the court’s original “Provisions for Electronic Filing”. The public comment period is now open until January 29, 2010. Amended Administrative Procedures and Guidelines for Electronic Filing have also been adopted. These also become effective on March 1. Training for non-ECF users will be available from the Clerk’s Office with additional resources after the first of the year to accommodate the expected increase in filers needing training. Attorneys and trustees who file some documents electronic and some in paper should begin to re-evaluate internal processes to make the complete conversion to electronic filing by March 1. The benefits of electronic filing are well documented (i.e., near 24/7 access to filing, email notices of all activity in your cases, electronic submission of proposed orders) and everyone gains when we are all using one system. We will work together to make this transition as smooth as possible. Absent further order of this court and to allow non-CM/ECF users to become participants, the effective date of this order shall be March 1, 2010. Please make sure you read this information carefully and pass this information on to others who may be affected by these mandated changes. — Barry Lander CM/ECF was unavailable from 7 p.m. Thursday, November 26 until 2 p.m. Friday, November 27 to install a required update to the software. The first thing you will notice is a mandated requirement to affirmatively indicate that you understand the Judiciary's redaction requirements. The text of the message that will appear on the login screen is presented below. For those of you using petition preparation software, there may be an update to handle this requirement from your vendor. Below this message, a checkbox appears to affirm that the notice has been read and understood. All outside filers must check this box to log in. Important Notice regarding Time Period Changes Effective December 1, 2009, including 14-Day Deadlines for Filing Schedules, Statements, Chapter 13 Plans, and Bankruptcy Appellate Briefs Among the time-computation amendments to the Federal Rules of Bankruptcy Procedure that will take effect on December 1, 2009 are changes to 12 rules that will result in a reduction by one day (from 15 to 14 days) of the time to take action. The affected rules are Bankruptcy Rules 1007, 1019, 1020, 2015, 2015.1, 2016, 3015, 4001, 4002, 6004, 6007, and 8009. Please take note of these changes and particularly of the new 14-day deadline for filing schedules, statements, and other documents under Rule 1007(c); for filing a chapter 13 plan under Rule 3015(b); and for filing appellate briefs under Rule 8009(a). General Order 174 was entered on October 28, 2009 to amend the Local Rules to be consistent with these changes. Revised Local Forms will be posted December 1. Northern District of California Bankruptcy Judgeship Opportunity Available— posted November 3, 2009 The Ninth Circuit Court of Appeals invites applications from highly qualified candidates for the position of Bankruptcy Judge for the Northern District of California. The person selected will maintain chambers in San Jose, California. Appointment is for 14 years, subject to possible reappointment. No relocation expenses are provided. Qualifications include (1) admission to practice before the highest court of at least one state, the District of Columbia or the Commonwealth of Puerto Rico; (2) membership in good standing in every bar in which membership is held; and (3) at least five years of legal practice experience (certain other legal experience may be substituted). On October 28, 2009, the Court entered General Order 174 to amend Local Bankruptcy Rules as affected by the changes. Comments will be accepted through November 30, 2009.
