Central District of CA Bankruptcy Judgeship Opportunity Available — posted December 17,2010

The Ninth Circuit Court of Appeals invites applications from highly qualified candidates for two Bankruptcy Judge position for the Central District of California. Appointment is for 14 years, subject to possible reappointment. No relocation expenses are provided. Qualifications include (1) admission to practice before the highest court of at least one state, the District of Columbia, or the Commonwealth of Puerto Rico; (2) membership in good standing in every bar in which membership is held; and (3) at least five years of legal practice experience (certain other legal experience may be substituted). Undeliverable BNC Notices — posted July 13, 2010

The Bankruptcy Noticing Center (BNC) mails notices from the Bankruptcy Court, based on information provided by the debtor, and in some instances, by the creditor. Beginning July 12, 2010, the BNC will no longer print and mail notices with invalid addresses that are undeliverable. For details, please click here.

Revised Forms Pages— posted June 25, 2010

The Forms page on the Court’s Web site has been revised. Clicking on the Court Forms hyperlink still opens the Court Forms page. This page now contains packages of frequently filed forms.

From the Court Forms page, clicking on the Individual Forms hyperlink takes you to the Individual Forms page, which lists separate forms in alphabetical order. You can search for a form by form title or by form number. Directions for these searches are listed on the Individual Forms page.

Also from the Court Forms page, a new hyperlink titled Filing without an Attorney takes users to a page devoted to those filers not represented by an attorney (pro se filers). This new page provides instructions and forms for pro se filers.


Important Notice: Extension of Time for Comments re: Adequate Protection General Order— posted June 11, 2010

On May 3, 2010, the Court entered General Order 175 after considering the requirements of 11 U.S.C. 1326(a)(1)(B) and (C).

The Court received and reviewed comment following the publication of General Order 175 and determines as follows: The implementation of General Order 175 is suspended to permit additional comment on this issue.
The period of comment is reopened and will run through and including July 12, 2010. Any comments should be submitted to the Clerk of the Court at 325 West F Street, San Diego, California 92101-6991. Please note on the envelope: “In re: 1326(a)(1) Payments.” General Order 175 is amended to delete the current effective date of June 10, 2010 and to provide that the Court will establish the effective date by further order entered after July 12, 2010. See General Order 175a.


Western District of WA Bankruptcy Judgeship Opportunity Available — posted June 1, 2010

Updated Forms CSD 1177 & 1178 — posted May 19, 2010

Forms CSD 1177 (Application for Compensation & Confirmation of Chapter 13 Plan and Order Thereon) and CSD 1178 (Application for Confirmation of Chapter 13 Plan and Order Thereon) have been revised to include a new paragraph II.C at the bottom of Page 2 of both forms. Paragraph II.C provides language regarding nondischargeable debts under 11 U.S.C. 1328(a) consistent with the recent Supreme Court Decision in United Student Aid Funds v. Espinosa (08-1134).

These updated forms are now available for use in Chapter 13 cases in the U.S. Bankruptcy Court - Southern District of California, and they have been posted on our Forms page.


Chapter 13 Adequate Protection Payments - General Order 175 — posted May 3, 2010

On May 3, 2010, the Court entered General Order 175 after considering the requirements of 11 U.S.C. 1326(a)(1)(B) and (C). Comments will be accepted through June 3, 2010. Absent any further order of the Court, the rule will become effective June 10, 2010. Any comments should be submitted to the Clerk of Court at 325 West F Street, San Diego, CA 92101-6991.
