Required Documents for Bankruptcy Case Opening

Introduction

 

When you file a new bankruptcy case, you must include specific documents with the petition. Also, you must separately file certain other documents after the case has been opened and has a case number.

  • Describe which documents must be filed with Chapter 7, 13, and 11 cases

The CM/ECF Online Manual details exact instructions for bankruptcy filing. In the manual, click on Search button, then type Chapter 7 Bankruptcy Case, Chapter 13 Bankruptcy Case, or Chapter 11 Individual Bankruptcy Case.

However, these tables (shown below) summarize which documents must be filed with Chapter 7, Chapter 13, and Chapter 11 cases.

Chapter 7 | Chapter 13 | Chapter 11

Chapter 7 Cases

Include these documents with the petition:

  • Petition page
  • Schedules A - J
  • Statement of Financial Affairs (Form B7)
  • Summary of Schedules
  • Statistical Summary of Certain Liabilities

For individual consumer cases only, you must file these documents in addition to those shown above:

  • Statement of Current Monthly Income & Means Test (Form 22A)
  • Exhibit D
 

File these documents separately:

  • Declaration re: Electronic Filing (CSD 1801)

Note: Requires scanned original signatures

  • Statement of Social Security Number (Form B 21)

Note: For individual consumers cases only. Form B 21 is due the same day the case is filed.

  • Certificate of Creditor Counseling (for individual consumer cases only)

or

  • Certificate of Exigent Circumstances & Motion to Extend Time (CSD 1025) with the uploaded Order (CSD 1026)

or

  • Motion for Exemption from Credit Counseling (CSD 1027) with the uploaded Order (CSD 1028)

Chapter 13 Cases

Include these documents with the petition:

  • Petition page
  • Schedules A - J
  • Statement of Financial Affairs (Form B7)
  • Summary of Schedules
  • Statistical Summary of Certain Liabilities

For individual consumer cases only, you must file these documents in addition to those shown above:

  • Statement of Current Monthly Income & Calculation of Commitment Period & Disposable Income (Form 22C)
  • Exhibit D
 

File these documents separately:

  • Declaration re: Electronic Filing (CSD 1801)
