Fee Changes, effective January 1, 2007
The latest fee increases involve appeals, conversions, reopenings and division of a joint case at the request of the debtor. New case filing fees remain unchanged.

- Chapter 13 to Chapter 7 has increased to $25.
|
- See the Fee Schedule for fees related to cases converted from a Chapter 12.

- No fee will be charged for cases converted sua sponte.
|
Case Reopening Fees and Split Case Fees
|

|
|
|
|
- In addition, exemptions to payment of the Case Reopening Fee have been narrowed considerably. Only motions to reopen a case to file a § 523 adversary complaint to determine dischargeability of a debt under Rule 4007(b) or to seek action against a creditor violating the terms of the discharge under 11 U.S.C. § 524 are exempt from the reopening fee.

Chapter 11 |

It appears that Congress intended to increase Chapter 11 filing fees as well, from $1,000 to $2,750, which would raise the total fees due at filing to $2,789. However, there is a drafting error in the bill which incorrectly references the statutory subsection prescribing the Chapter 9 fee, rather than the Chapter 11 fee. Thus at this time the Chapter 11 fee is unaltered. We will keep you apprised of Congress' actions to address this drafting error.
