Pursuant
to Local Bankruptcy Rule 9010-5, the substitution of attorneys
is governed by District Court Local Rule 83.3(g)(2) which states
that attorney substitutions are to be approved by the court and
signed by the party making the substitution, the attorney ceasing
to act and the newly appointed attorney. Therefore, to facilitate
the attorney substitution process and to comply with District
Court Local Rule 83.3(g)(2), the court implemented the new form
and order CSD 3011 - Substitution of Attorney and Order Thereon.
IMPORTANT:
- For
Adversary cases, upload the order through the Adversary menu
option.
- For Bankruptcy
cases, upload the order through the Bankruptcy menu option.
- In
the event that the substitution of attorney affects both the
Bankruptcy and the Associated Adversary case, the order must
be uploaded into both the Bankruptcy and the Adversary cases,
as separate entries.
Follow the below
instructions to upload this order successfully.
- Select Bankruptcy
or Adversary menu.
- Select Order Upload.
- Select Single Order
Upload.
- Enter case number.
- Enter related document
number.
- For a Bankruptcy
Case:
- If a Substitution
of Attorney pleading was filed, select the document
number for the Substitution of Attorney. Click here if you do not know
related document number.
- If no Substitution
of Attorney pleading was filed, select the document
number for the Voluntary Petition
- For an Adversary
Case:
- If a Substitution
of Attorney pleading was filed, select the document
number for the Substitution of Attorney. Click here if you do not know
related document number.
- If no Substitution
of Attorney pleading was filed, select the document
number for the Adversary Complaint
- Select Order
Type: All
Other Orders.
- Bypass
Hearing
date and time.
