Motion to Dismiss Bankruptcy Case

Use this document event to motion the court to dismiss a BANKRUPTCY case only.  To dismiss an ADVERSARY case, see Motion to Dismiss in the Motions/Applications category.

If a Notice of Motion or Request for Hearing accompanies this Motion, file this Motion prior to the Notice.  The Notice (or Request for Hearing) must be filed under its own document event and referred (linked) to this Motion.

  1. Select Bankruptcy menu.
  2. Select Motions/Applications.
  3. Ensure correct case name and number match the document you are filing.
  4. Select party filer.
  5. Select Document Event: Dismiss Bankruptcy Case (Motion).
  6. Browse, verify and attach the document (PDF file).
  7. Bypass box at Refer to existing event(s).
  8. Select applicable Reason for Dismissal. Note: A selection MUST be made. Do not bypass the screen.
    • for failure to file documents Rule 1007 and/or 521 (i.e., Schedules, B21, tax returns.)
    • for abuse 11 USC707(b)
    • for failure to make plan payments
    • for other reason
  9. Modify text to add pertinent information, such as Amended, if applicable.
  10. Verify final docket text before submitting onto case docket.
  11. Print the Notice of Electronic Filing. It's your receipt.
  12. Continue with filing the Notice or Request for Hearing, if applicable.
