Comments Solicited - Revised Mandatory Chapter 13 Plan, Chapter 13 Rights and Responsibilities and Guideline Fees - General Order 173-B

The Court having considered the requirements of amended Federal Rule of Bankruptcy Procedure 3015, effective December 1, 2017, proposes changes to its mandatory Chapter 13 Plan (currently CSD 1300.1 to be renumbered CSD 1300). In addition, the court also has completed a review of the Chapter 13 Rights and Responsibilities documents for both consumer and business cases including the presumptive fees. Download the redline and non-redline versions of the three documents.

Local Bankruptcy Rule 3015-1 will be amended on the effective date for these forms to reflect the change to the form number of the Mandatory Chapter 13 plan.

The period for comment extends through October 13, 2017. Except as set forth in a further order of this court, the effective date for these changes is December 1, 2017.
