Now Effective: Local Rules Amendment Adopting Mandatory Chapter 13 Plan and Guidelines & Revised Fee Schedule

After multiple periods allowing for public comment, Local Bankruptcy Rule 3015-1 implementing the mandatory Chapter 13 Plan (CSD 1300.1) became effective on June 1, 2016. The Local Bankruptcy Rules and Administrative Procedures have been updated to reflect this change. In addition to the changes needed to implement the rule change, three typographical errors have been corrected and the appendices have been updated to reflect a new fee related to changes at the Federal Records Center (Appendix A) and to add the new required form to Appendix C.

The previous “recommended” Chapter 13 plan form remains available on the court's Court Forms page for cases filed prior to June 1, 2016 and for amendments or modifications in those cases.

Again, the bankruptcy court thanks the committee of trustees and practitioners who participated in the development of the form and guidelines.
